1. Introduction

Tandem Surveys was created, with the core mission of helping businesses, universities and professionals create surveys that are easy to answer, and easy to analyse.

Tandem Surveys is bound by the National Privacy Principles contained in Schedule 3 of the Privacy Act 1988 (Cth) (as amended from time to time).

Tandem Surveys policies with regards to the management of the personal information of the Tandem Surveys members are set out in this policy. “Personal information” in this policy has the same meaning as under the Privacy Act.

2. Where this Policy applies

This Policy applies to personal information that Tandem Surveys may collect from one of the following sources:

• via one of our websites;
• via social media;
• via telephone;
• via email;
• via fax;
• in person; and/or
• in writing.

3. The Tandem Surveys Website

The Tandem Surveys website collects two types of information. The first type is anonymous information. The web server makes a record of your visit and logs the following information for statistical purposes:

• the user’s server address;
• the user’s top level domain name (e.g. .com, .gov, .net, .au, etc.);
• the date and time of the visit to the site;
• the pages accessed and documents downloaded;
• the previous site visited; and
• the type of browser used.

No attempt will be made to identify users or their browsing activities except, in the unlikely event of an investigation, where a law enforcement agency may exercise a warrant to inspect the internet service provider’s logs.

The second type of information that Tandem Surveys website collects is personal information. Personal information is requested in order to provide personalised and enhanced services that are not available to anonymous users.

A cookie is a piece of data stored on the user’s computer tied to information about the user. Cookies may be used on the Tandem Surveys website.

Our website may contain links to other websites and social media pages including Facebook,
their surveys. We are not responsible for the privacy policies of the entities responsible for those websites and we recommend that you review the privacy policies applicable to any other websites you visit.

4. Why does Tandem Surveys collect personal information?

The information collected by the Tandem Surveys is used to assist it to achieve the objects of Tandem Surveys.

5. What personal data will the Tandem Surveys collect?

Depending upon the circumstances, you may provide to Tandem Surveys, and Tandem Surveys may collect, information such as, but not limited to:

• your name;
• your contact details;
• your social media details (e.g. blogs, twitter, Facebook, Instagram LinkedIn);
• your gender;
• your marital status;
• your employment details; and
• your educational qualifications.
And any information specific to the requirements of a tandem survey customer survey.

Some personal information is considered sensitive information and includes:

• your political opinions;
• your racial or ethnic origin;
• your sexual orientation;
• any disabilities, illnesses or injuries you may have; and/or
• any other health information.

For users that register on our website, we also store the personal information they provide in their user profile. Website administrators can also see and edit that information.

We will only collect sensitive information where we have received your consent to that information being collected, used, disclosed and stored by the Tandem Surveys in accordance with this Policy, and provided that the collection is reasonably necessary for us to pursue one or more of our functions or activities.

If we receive unsolicited personal information about or relating to you and we determine that such information could have been collected in the same manner if we had solicited the information, then we will treat it in the same way as solicited personal information and in accordance with the APPs. Otherwise, if we determine that such information could not have been collected in the same manner as solicited personal information, and that information is not contained in a Commonwealth record, we will, if it is lawful and reasonable to do so, destroy the information or de-identify the information.

6. What if I do not wish to provide personal information? You may choose not to provide personal information unless required by law.

However, if personal information is not provided, Tandem Surveys may be unable to provide you with certain services or benefits.

7. How does the Tandem Surveys use and disclose personal information?

Tandem Surveys may need to disclose your personal information in the following circumstances:

• With third parties for the purpose of data processing.
• Delivery of AI Features.
• And with relevant technical providers for the delivery of the service.

The Tandem Surveys will only use or disclose information:

(a) for the purposes for which it was collected (the primary purpose);
(b) for a secondary purpose that:
(i) is related to the primary purpose; and
(ii) the individual would reasonably expect his or her information to be used or disclosed for this secondary purpose; or
(c) where there is consent of the individual concerned to the use or disclosure; or
(d) as otherwise allowed under the Acts, or required or authorised by or under law.

8. What if I do not want my personal information to be disclosed?

If you do not want your personal information to be disclosed, Tandem Surveys will endeavour to accommodate this request unless the disclosure is required by law.
However, if your personal information is not disclosed or if you choose to opt out of receiving any communications from Tandem Surveys, we may be unable to provide you with certain services or benefits.

9. How can I access personal information held about me?

You may request access to personal information we hold about you by writing to the support team support@tandemsurveys.com. Your request must detail your name, contact details, your former name or alias if any and the information you believe that Tandem Surveys may have about you. You do not have to provide a reason for requesting access. Where we hold information that you are entitled to access, we will endeavour to respond within 10 working days of receiving a written request. However, Tandem Surveys may refuse to provide any person with access to information where the Tandem Surveys is permitted by law to withhold that information.

10. How can I amend incorrect, incomplete or inaccurate information about me?

If you believe that personal information we hold about you is incorrect, incomplete or inaccurate, then you may request us to amend it. We will have the discretion to determine whether the information requires amendment. If we agree that the information requires amendment then your request will be complied with. However, if we conclude that there are no grounds for amendment, then we will add a note to the personal information we hold stating that you disagree with it.

11. How secure is my personal information in the Tandem Surveys database?

Tandem Surveys will endeavour to take all reasonable steps to keep all personal information secure and to protect that personal information from misuse or loss and from unauthorised access, modification or disclosure.

When using Tandem Surveys website you should be aware that no data transmission over the Internet can be guaranteed as totally secure. Although Tandem Surveys endeavours to protect such information, Tandem Surveys does not guarantee the security of any information transmitted to it over the Internet. Any information transmitted to Tandem Surveys over the Internet is at the risk of the person transmitting the information.

Tandem Surveys complies with the Notifiable Data Breaches Scheme which commenced on 22 February 2018. This affects breaches that occurred on or after this date. The Notifiable Data Breaches Scheme introduced an obligation to notify individuals whose personal information is involved in a data breach that is likely to result in serious harm. The notification must include recommendations about the steps taken in response to the breach and the Australian Information Commissioner must be notified of an Eligible Data Breach. Although serious harm is not defined by the Privacy Act, in the context of a data breach, serious harm to an individual may include serious physical harm, psychological harm, emotional harm, financial harm or reputational harm.

Samples of serious harm to an individual may include identity theft, significant financial loss by the individual, threats to an individual’s safety, loss of business or employment opportunities, humiliation, damage to reputation or relationships, workplace or social bullying or marginalisation. A data breach occurs when personal information held by an organisation is lost or subjected to unauthorised access or disclosure.

An eligible data breach arises when the following three criteria is satisfied:

• There is unauthorised access to, or unauthorised disclosure of, personal information, or a loss of personal information, that an entity holds;
• This is likely to result in serious harm to one or more individuals; and
• The entity has not been able to prevent the likely risk of serious harm with remedial action.

12. Use of information for direct marketing

You consent to our use and disclosure of your personal information for the purposes of direct marketing which may include providing you with promotional material, information about events, products or services of Tandem Surveys or third parties such as partners and sponsors, which may be of interest to you, now and in the future.

If you do not want us to use your personal information for direct marketing purposes, you may elect not to receive direct marketing at the time of providing your personal information. You can opt out when you are contacted, or you can contact us using the contact details set out below, if you do not want to receive marketing information.
